These Terms of Service ("Terms") are a legally binding agreement between you ("User," "you," or "your") and Yashraj Awasthi, operating as a sole proprietorship under the trade name Val8 ("Val8," "we," "us," or "our"). These Terms govern your access to and use of the Val8.app website, application, and all associated services (collectively, the "Service").

By creating an account, accessing the Service, purchasing credits, or submitting any content through the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to any part of these Terms, you must not use the Service.

1. Acceptance of Terms and Eligibility

1.1 Agreement to Be Bound

Your use of the Service constitutes your acceptance of and agreement to these Terms. This agreement takes effect the moment you create an account, access any part of the Service behind the login screen, or make any purchase on the platform - whichever occurs first.

1.2 Age Requirement

You must be at least eighteen (18) years of age to use the Service. If you are under 18, you are not permitted to create an account, purchase credits, or submit any content to the Service. During registration, you must confirm your age via a self-certification checkbox ("I confirm I am 18 years of age or older"). By checking this box and creating an account, you represent and warrant that you are at least 18 years old. If we discover or have reasonable grounds to believe that a User is under 18 - whether through a user report, support ticket, complaint, or any other means - we reserve the right to immediately suspend or terminate the account without notice and without any obligation to refund credits or provide compensation.

1.3 Legal Capacity

By agreeing to these Terms, you represent and warrant that you have the legal capacity to enter into a binding agreement under the laws of the jurisdiction in which you reside. If you are using the Service on behalf of a business, company, or other legal entity, you represent that you have the authority to bind that entity to these Terms, and "you" and "your" will refer to both you individually and the entity you represent.

1.4 Account Registration Required

Access to all core features of the Service - including submitting a business idea for validation, purchasing credits, and viewing validation results - requires you to create a registered account. You may browse the public-facing landing page without an account, but you cannot use any functional part of the Service without one.

1.5 Account Accuracy and Security

When creating an account, you agree to:

Provide accurate, current, and complete information during registration.
Maintain and promptly update your account information to keep it accurate and current.
Maintain the confidentiality of your account credentials (email address and password).
Accept full responsibility for all activities that occur under your account, whether or not you authorised them.
Notify us immediately at founder@val8.app if you become aware of any unauthorised use of your account or any other security breach.

You may not share your account credentials with any other person, create multiple accounts for the same individual, or use another person's account without their explicit permission. We are not liable for any loss or damage arising from your failure to comply with these requirements.

2. Description of the Service

2.1 What Val8 Does

Val8 is an AI-powered business idea validation platform. When you submit a business idea, the Service processes it through an AI-simulated panel of forty-five (45) distinct personas. These personas represent three categories: investors, subject-matter experts, and potential end-users relevant to your idea's domain.

The AI panel deliberates on your idea and produces a structured feedback report that includes:

Numerical scores across multiple evaluation dimensions.
Identified strengths and weaknesses of the idea.
Objections, concerns, and risks surfaced by the simulated personas.
A recommended next validation step.

2.2 What Val8 Is Not

The Service is an informational tool. It is not any of the following:

Investment advice, financial advice, legal advice, or professional consulting of any kind.
A guarantee that any business idea will succeed, attract funding, generate revenue, or achieve market traction.
A substitute for real-world market research, customer interviews, financial modelling, legal due diligence, or professional advisory services.
A marketplace for connecting founders with real investors, mentors, advisors, or customers.

The outputs of the Service are AI-generated simulated opinions produced by artificial personas. They do not reflect the views or analysis of any real human being, investor, expert, or potential customer. See Section 6 for full disclaimers on AI-generated content.

3. Credits and Pricing

3.1 Credit System

The Service operates on a prepaid credit system. Credits are a digital unit of account that represent your prepaid access to use the validation feature. Credits are not currency, are not legal tender, have no cash value, and cannot be exchanged for cash or transferred to another user.

3.2 Credit Requirement

The Service offers two modes of validation:

Quick Mode: Requires one (1) credit per run.
Full Panel: Requires two (2) credits per run.

You must have a sufficient credit balance in your account before you can initiate your chosen validation mode. If your balance is below the required amount, you will be prompted to purchase additional credits before proceeding.

3.3 Credit Packages and Pricing

Credits are available for purchase in the following packages:

Indian users are billed in Indian Rupees (INR). International users are billed in United States Dollars (USD). The billing currency is determined automatically based on your payment method and location.

3.4 Credits Do Not Expire

Once purchased, credits remain in your account indefinitely. There is no expiration date, no inactivity penalty, and no time limit within which you must use them. Your credit balance rolls over across multiple purchases.

3.5 Pricing Changes

We reserve the right to change the pricing of credit packages at any time. Any price change will apply only to future purchases made after the change takes effect. Price changes will never retroactively affect credits you have already purchased - credits already in your account will retain their full value regardless of any subsequent price adjustments.

We will make reasonable efforts to notify registered users of significant pricing changes via the email address associated with their account or through a notice on the website, but we are not obligated to provide advance notice for pricing adjustments.

3.6 Payment Processing

All payments are processed through Razorpay, our third-party payment processor. By purchasing credits, you agree to Razorpay's terms of service and privacy policy in addition to these Terms. We do not store, process, or have access to your raw credit card numbers, debit card numbers, or full bank account details. Payment data is handled directly by Razorpay in accordance with applicable payment security standards.

3.7 Taxes

All prices listed are final at the time of purchase. Val8 is currently operated as an unregistered sole proprietorship and is not GST-registered; therefore, GST is not charged on your purchases. This section will be updated if and when our registration status changes. International users are responsible for any applicable taxes, duties, or fees imposed by their local jurisdiction. We are not responsible for calculating, collecting, or remitting taxes on behalf of international users except where required by Indian law.

3.8 Failed Runs and Automatic Credit Refunds

If a paid validation run fails partway through due to a technical error, server error, or third-party API failure that is not caused by your actions, the exact amount of credits consumed by that run (1 or 2 credits, depending on the chosen mode) will be automatically refunded to your account balance. This refund is applied as a credit balance restoration, not as a monetary refund to your payment method. You will be able to use these restored credits for a subsequent validation run.

4. Acceptable Use and Content Moderation

4.1 Acceptable Use

You agree to use the Service only for its intended purpose: submitting genuine business, product, or service ideas for AI-powered validation feedback. You may submit ideas that are vague, early-stage, unconventional, or even ideas you suspect may be weak - evaluating the viability of ideas at any stage of development is the core purpose of this tool.

4.2 Prohibited Content

You agree not to submit any content through the Service that:

a) Falls into a prohibited business category:

Illegal drug manufacturing, trafficking, or distribution.
Weapons, firearms, ammunition, or explosives manufacturing, trafficking, or distribution.
Human trafficking, exploitation, or any form of child exploitation.
Fraud, scam operations, Ponzi schemes, phishing services, or schemes designed to defraud.
Malware development or distribution, hacking tools or services, unauthorised surveillance or stalking tools.
Counterfeiting of currency, goods, official documents, or intellectual property.
Terrorism, violent extremism, or material support for terrorist organisations.
Gambling, betting, or wagering platforms of any kind.
Adult content, pornography, or sexually explicit service platforms.
Cannabis, recreational drugs, or other controlled substance businesses, regardless of local legality.
Cryptocurrency, blockchain-based financial instruments, or high-risk unregulated fintech products.
Alcohol or tobacco retail, distribution, or manufacturing.
Multi-level marketing (MLM), pyramid-structured sales models, or aggressive network marketing schemes.

b) Contains harmful, abusive, or illegal content:

Hate speech, content promoting violence or discrimination against any individual or group based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic.
Content that promotes, glorifies, or incites violence, terrorism, or self-harm.
Sexually explicit, obscene, or pornographic material.
Harassment, threats, intimidation, or bullying directed at any individual or group.
Content that infringes upon the intellectual property rights, privacy rights, or other legal rights of any third party.
Any content that violates applicable local, state, national, or international law.

c) Is not a business idea at all:

General conversation, small talk, jokes, or social chatter.
Questions about the Service, technical support requests, or meta-commentary (use founder@val8.app for these).
Gibberish, random characters, test strings, or meaningless input.
Attempts to manipulate, jailbreak, or extract the underlying AI system prompts, model weights, or internal logic.
Attempts to use the Service as a general-purpose AI assistant, chatbot, or content generation tool.

4.3 Automated Content Screening

All submitted ideas are automatically screened by our content moderation system before any validation processing begins. This screening occurs in two layers:

Layer 1: Third-party moderation (OpenAI Moderation API) screens for universally harmful content categories.
Layer 2: Our custom business-context classifier evaluates whether the submission is a genuine business idea and whether it falls into a prohibited category.

If your submission is rejected by either layer, you will receive a generic rejection message. No credits will be charged for rejected submissions. We do not disclose which specific rule or category triggered a rejection, and we do not provide detailed explanations for individual moderation decisions. This is a deliberate design choice to prevent circumvention of the moderation system.

4.4 False Positives and Feedback

If you believe your legitimate business idea was incorrectly rejected by the moderation system, you may contact us at feedback@val8.app with a description of your idea. We will review your case and, at our sole discretion, may whitelist specific submissions or adjust our moderation rules. We are not obligated to reverse any moderation decision, but we take false positives seriously because they directly affect product quality for paying users.

4.5 Consequences of Misuse

If we determine, at our sole discretion, that you have violated the acceptable use policy described in this section, we may take one or more of the following actions without prior notice:

Reject the specific submission without charging credits.
Issue a warning to your account.
Temporarily suspend your account and access to the Service.
Permanently terminate your account.
Forfeit any remaining credits in your account without refund.

In cases of serious, repeated, or clearly intentional violations - including but not limited to submitting content that promotes illegal activity, attempting to circumvent the moderation system, or engaging in fraudulent activity - we reserve the right to immediately and permanently terminate your account and forfeit all remaining credits without warning, notice, or refund.

4.6 No Obligation to Monitor

While we implement automated content screening, we do not manually review every submission in real time. We reserve the right, but have no obligation, to monitor, review, or screen any content submitted through the Service. The existence of automated moderation does not create a duty for us to catch every policy violation.

5. Intellectual Property

5.1 Your Content - Ownership

You retain full ownership of any business idea, concept, description, or other content that you submit through the Service ("User Content"). Nothing in these Terms transfers any intellectual property rights in your User Content to Val8. We do not claim ownership of your ideas.

5.2 Limited License to Process

By submitting User Content through the Service, you grant Val8 a limited, non-exclusive, worldwide, royalty-free license to:

Process your User Content through our internal systems and third-party AI providers (currently DeepSeek and OpenAI) solely for the purpose of generating your validation report.
Store your User Content in our database systems for the purpose of associating it with your account and making your past validation reports accessible to you.

This license exists solely to enable us to provide the Service to you. We will not sell your User Content, publish it publicly, share it with other users, use it for advertising, or license it to any third party for their independent commercial purposes.

5.3 Third-Party AI Processing

To provide the Service, your submitted idea text is sent to the following third-party AI providers for processing:

DeepSeek (models: deepseek-v4-flash and deepseek-v4-pro) - generates the simulated persona panel, discussion, and scoring that form your validation report.
OpenAI (Moderation API, model: omni-moderation-latest) - screens your submitted text for policy violations before any other processing occurs.

By using the Service, you acknowledge and consent to your User Content being transmitted to and processed by these third-party providers. Each provider processes data in accordance with their own terms of service, privacy policies, and data handling practices. We select providers that we believe maintain commercially reasonable data security practices, but we cannot guarantee how third-party providers handle data after it leaves our systems.

5.4 AI-Generated Output

The validation reports, scores, persona discussions, and all other output generated by the Service ("Output") are produced by AI models. You are granted a non-exclusive, perpetual license to use the Output for your own personal and commercial purposes (for example, to inform your business decisions, include in pitch materials, or share with advisors).

We do not guarantee that Output is unique to you. Because AI models are probabilistic, similar inputs from different users could produce similar outputs. We make no representation that Output constitutes novel, proprietary, or confidential analysis.

5.5 Val8 Intellectual Property

All rights, title, and interest in the Service itself - including the website design, code, algorithms, prompts, AI orchestration logic, scoring methodology, user interface, branding, logos, documentation, and all other elements of the platform - are and remain the exclusive property of Val8. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it as a registered user in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or create derivative works based on any part of the Service. You may not scrape, crawl, or use automated tools to extract data or content from the Service. You may not use the Val8 name, logo, or branding without our prior written consent.

6. AI-Generated Content Disclaimer

6.1 Not Professional Advice

The validation reports and all other outputs produced by the Service are AI-generated simulated opinions. They are created by artificial intelligence models simulating hypothetical personas. These outputs:

Do not constitute investment advice, financial advice, legal advice, tax advice, accounting advice, or professional consulting of any kind.
Do not represent the views, opinions, or analysis of any real human being, whether an investor, industry expert, potential customer, or any other person.
Do not guarantee or predict the commercial success, market viability, profitability, or fundability of any business idea.
Are provided for informational and educational purposes only.

6.2 No Guarantee of Accuracy

AI models can produce outputs that are inaccurate, incomplete, biased, contradictory, outdated, or factually wrong. We do not guarantee the accuracy, reliability, completeness, timeliness, or usefulness of any output produced by the Service. You should not rely solely on Val8 outputs when making business decisions, investment decisions, or any other decisions with financial, legal, or strategic consequences.

6.3 User's Responsibility

You are solely responsible for independently evaluating any business idea and for any decisions you make based on or influenced by the outputs of the Service. We strongly recommend that you supplement Val8 outputs with real-world market research, customer validation, professional advisory services, financial modelling, and legal counsel before acting on any business idea.

6.4 No Fiduciary or Advisory Relationship

Use of the Service does not create any fiduciary relationship, advisory relationship, client-professional relationship, or any other special relationship between you and Val8. We owe you no duty of care, duty of loyalty, or fiduciary duty beyond the obligations explicitly stated in these Terms.

7. Refund and Cancellation Policy

Refunds and cancellations are governed by our separate Refund & Cancellation Policy, which is available on our website and incorporated into these Terms by reference. By agreeing to these Terms, you also agree to the Refund & Cancellation Policy.

For clarity: automatic credit restoration for failed validation runs (as described in Section 3.8 of these Terms) is separate from and in addition to any refund rights described in the Refund & Cancellation Policy.

8. Limitation of Liability

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT, DATA, OR OUTPUT PROVIDED THROUGH THE SERVICE.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VAL8, ITS OWNER (YASHRAJ AWASTHI), OR ANY OF ITS AFFILIATES, EMPLOYEES, CONTRACTORS, AGENTS, OR SERVICE PROVIDERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR:

a) Any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:

Loss of profits, revenue, business, or anticipated savings.
Loss of goodwill or reputation.
Loss of data or business information.
Cost of procurement of substitute goods or services.
Any damages arising from business decisions made in reliance on the Service's outputs.

b) Any damages arising from:

Your use of or inability to use the Service.
Any errors, inaccuracies, or omissions in the AI-generated outputs.
Unauthorised access to or alteration of your data or account.
Any third-party conduct or content on or related to the Service.
Any interruption, suspension, or termination of the Service.

8.3 Maximum Liability Cap

IN ANY EVENT, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE ACTUALLY PAID TO VAL8 IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE THOUSAND INDIAN RUPEES (₹1,000), WHICHEVER IS GREATER. THIS CAP DOES NOT LIMIT STATUTORY REMEDIES UNDER APPLICABLE CONSUMER PROTECTION LAW THAT CANNOT BE CONTRACTUALLY EXCLUDED.

8.4 Essential Purpose

YOU ACKNOWLEDGE THAT THE LIMITATIONS AND EXCLUSIONS SET FORTH IN THIS SECTION REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK BETWEEN YOU AND VAL8, AND THAT THESE LIMITATIONS FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN THE PARTIES. THE SERVICE WOULD NOT BE PROVIDED TO YOU WITHOUT THESE LIMITATIONS.

8.5 Jurisdictional Variations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability is limited to the maximum extent permitted by applicable law. Nothing in these Terms is intended to exclude or limit liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence causing personal injury, or any other liability that mandatory law does not permit to be limited.

9. Account Termination

9.1 Termination by You

You may terminate your account at any time by using the account deletion feature within the Service or by contacting us at founder@val8.app. Upon termination:

Your account will be deactivated and you will lose access to the Service.
Any unused credits remaining in your account at the time of voluntary termination will be forfeited. Credits are non-refundable upon voluntary account termination unless otherwise required by applicable law.
Your past validation reports may be deleted from our active systems, though we may retain certain data as required by law, for fraud prevention, or for legitimate business purposes (such as maintaining moderation logs).

9.2 Termination by Val8

We may suspend or terminate your account, with or without prior notice, if:

You violate any provision of these Terms, including the acceptable use policy in Section 4.
You engage in fraudulent, abusive, or illegal activity through the Service.
You attempt to circumvent the content moderation system, payment system, or any other security or operational feature of the Service.
You create multiple accounts to evade a prior account suspension or termination.
We are required to do so by law, regulation, or a valid legal order.
We reasonably believe that your continued use of the Service poses a risk to the Service, other users, or third parties.

9.3 Effect of Termination for Cause

If we terminate your account for violation of these Terms (termination "for cause"):

All remaining credits in your account are immediately forfeited without refund.
You will lose access to all past validation reports and account data.
We may, at our sole discretion, prohibit you from creating new accounts in the future.
We may retain records of your account activity, submitted content, and moderation actions for our internal compliance, legal, and fraud prevention purposes.

9.4 Survival

The following sections survive termination of your account and these Terms: Section 5 (Intellectual Property), Section 6 (AI-Generated Content Disclaimer), Section 8 (Limitation of Liability), Section 10 (Governing Law and Dispute Resolution), and any other provision that by its nature is intended to survive termination.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms and any dispute, controversy, or claim arising out of or relating to these Terms, the Service, or your relationship with Val8, shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.

10.2 Jurisdiction

Subject to Section 10.3 below, you agree that the courts located in Kanpur, Uttar Pradesh, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. You irrevocably submit to the personal jurisdiction of these courts and waive any objection to the exercise of jurisdiction by these courts on the grounds of venue, forum non conveniens, or any similar ground. Notwithstanding the foregoing, this exclusive-jurisdiction clause does not waive your statutory right to approach a consumer forum or commission under the Consumer Protection Act, 2019 in the jurisdiction where you reside or where the cause of action arose.

10.3 Informal Resolution First

Before initiating any formal legal proceeding, you agree to first contact us at founder@val8.app and attempt to resolve the dispute informally. You must provide a written description of the dispute, including any relevant facts, your account details, and the specific relief you are seeking. We will attempt to resolve the dispute within thirty (30) days of receiving your notice. If the dispute is not resolved within this 30-day period, either party may then proceed with formal legal action as described in Section 10.2.

10.4 Class Action Waiver

To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Val8. This waiver does not limit your statutory right to file a joint or class complaint under Section 35 of the Consumer Protection Act, 2019, to the extent such a waiver is not enforceable under Indian law.

10.5 Compliance with Indian Law

The Service is operated from India. We make no representation that the Service is appropriate or available for use in any other jurisdiction. If you access the Service from outside India, you do so at your own risk and are responsible for compliance with all applicable local laws. We reserve the right to limit or restrict access to the Service from any jurisdiction at any time.

11. Changes to These Terms

11.1 Right to Modify

We reserve the right to modify, amend, or replace these Terms at any time at our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this document.

11.2 Notification of Material Changes

For material changes - changes that significantly affect your rights, obligations, or the way the Service operates - we will make reasonable efforts to notify you through one or more of the following methods:

11.3 Your Acceptance of Changes

Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may terminate your account in accordance with Section 9.1. Your sole remedy for disagreement with any change to these Terms is to stop using the Service.

11.4 No Retroactive Material Changes

Changes to credit pricing or package structure will apply only to future purchases, as stated in Section 3.5. We will not retroactively reduce the value or utility of credits you have already purchased.

12. Indemnification

You agree to indemnify, defend, and hold harmless Val8, its owner (Yashraj Awasthi), and any of its affiliates, contractors, agents, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

Your use of or access to the Service.
Your violation of these Terms or any applicable law.
Your User Content, including any claim that your User Content infringes the intellectual property rights or other rights of any third party.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with the Privacy Policy, Refund & Cancellation Policy, and any other policies or agreements expressly incorporated by reference, constitute the entire agreement between you and Val8 regarding the Service and supersede all prior or contemporaneous agreements, representations, warranties, and understandings, whether written, oral, or implied.

13.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if it cannot be so modified, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

13.3 Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Val8. A waiver on one occasion shall not be deemed a waiver on any subsequent occasion.

13.4 Assignment

You may not assign or transfer your rights or obligations under these Terms, whether by operation of law or otherwise, without our prior written consent. We may assign our rights and obligations under these Terms to a successor entity in connection with a sale, merger, acquisition, reorganisation, or transfer of all or substantially all of our assets, without your consent.

13.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, wars, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, epidemics or pandemics, internet or telecommunications failures, third-party service outages (including AI provider outages, payment processor outages, or cloud hosting outages), power outages, government actions, or any other event that is beyond our reasonable control. During the duration of such an event, our obligations under these Terms shall be suspended.

13.6 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights. No person or entity other than you and Val8 has any rights under or may enforce these Terms.

13.7 Headings

The section headings in these Terms are for convenience only and have no legal or contractual significance. They shall not affect the interpretation of these Terms.

13.8 Language

These Terms are drafted in English. If these Terms are translated into any other language for convenience, the English version shall prevail in the event of any conflict or inconsistency between the English version and any translation.
